Understand the major benefit of using a mediator and why you might want to try it.
Some negotiations are just a little tougher than others. These types of negotiations can easily turn into a vicious circle where the parties, sensing how things are developing, become even more reluctant to give in to anything and most likely lead to increased frustration on a personal level between the parties. Before declaring the negotiation completely unresolvable or passing the case on to legal entities, try to consult a mediator. Mediators are most often mentioned in the media when, for example, there is a looming conflict between union and employer, but a mediator can also be very valuable in other situations.
As a neutral third party, the mediator can help the parties try to find a way forward and reach an agreement and is a much cheaper option compared to, for example, dealing with the case through the court system.
The mediator, working under a duty of confidentiality, can more easily gain an understanding from both sides of what is really hindering a successful outcome of the negotiation and help the parties find an appropriate way forward.
